2. Service Description
Offshore Risk App is a Software-as-a-Service (SaaS) application that uses Artificial Intelligence (OpenAI Assistants API) to generate offshore risk assessment documents for Health, Safety & Environment (HSE) purposes. The Service allows registered users to:
- Input task or activity descriptions and receive AI-generated risk assessment reports
- Download generated reports as professionally formatted Excel (.xlsx) files based on a standardized template
- View and re-download previously generated reports from their dashboard
- Manage their subscription and billing through the Stripe Customer Portal
3. User Accounts
To use the Service, you must create an account by providing a valid email address and password. By registering, you agree to these Terms of Use and our Privacy Policy. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You may change your password or permanently delete your account at any time through the Account Settings page. Deleting your account will remove all your data and cancel any active Stripe subscription.
4. Subscription Plans & Credits
The Service operates on a credit-based subscription model. Subscriptions are purchased from the dashboard after registration. Available plans:
Freelancer – €9.90/month – 20 credits
Standard – €19.90/month – 50 credits
Enterprise – €49.90/month – 150 credits – includes multi-language report translation
Each report generation consumes one credit. Credits are reset upon each successful subscription payment and do not carry over to the next billing period. Unused credits expire at the end of each billing cycle.
5. Multi-Language Translation (Enterprise Only)
Enterprise plan subscribers have access to multi-language report generation powered by the DeepL API. Reports can be generated in English, Polish, Dutch, German, and Spanish. When a non-English language is selected, the AI-generated risk assessment content and Excel template headers are automatically translated. This feature is not available on Freelancer or Standard plans.
6. Liability Disclaimer
The Risk Assessments generated by this Service are drafts created by Artificial Intelligence. They may contain errors, inaccuracies, or omissions. The User is solely responsible for validating all hazards, control measures, risk scores, and compliance with applicable local regulations and safety standards before use. The Provider is not liable for any accidents, damages, injuries, or legal consequences resulting from the use of generated documents.
All generated documents should be reviewed, verified, and approved by qualified HSE professionals before being used in any operational context. The Service is intended as an aid to professionals, not a replacement for expert judgment. AI-generated translations (via DeepL) should also be reviewed for accuracy in safety-critical contexts.
7. Payments
All payments are processed securely by Stripe. By purchasing a subscription, you agree to Stripe's Terms of Service. The Provider does not store or have access to your full payment card details. Payment confirmation and credit allocation are handled automatically via Stripe webhooks.
8. Subscription & Cancellation
Subscriptions are billed on a monthly recurring basis. You may manage or cancel your subscription at any time through the Stripe Customer Portal, accessible via the "Manage Subscription" button on your dashboard. Upon cancellation, you will retain access to your remaining credits until the end of the current billing period. No refunds are provided for partial billing periods.
9. Intellectual Property
The generated risk assessment documents are provided for the User's professional use. The Service itself, including its code, design, branding, Excel templates, and AI prompt engineering, remains the intellectual property of the Provider.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from the use of this Service.
11. Changes to Terms
The Provider reserves the right to modify these Terms at any time. Users will be notified of significant changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
